From a legal perspective, child custody refers to the rights and responsibilities parents have concerning the care, control, and decision-making for their child after a separation or divorce. In Massachusetts, the process for obtaining child custody begins with filing a petition in the family court. The court, just like us, encourages parents to reach an agreement on custody arrangements through mediation or negotiation, but if an agreement cannot be reached, the court will hold a hearing to decide. During this process, the court evaluates evidence related to each parent’s ability to care for the child, including testimony, home visits, and reports from social workers or guardians ad litem. The court’s primary goal is to establish a custody arrangement that supports the child’s best interests, which may include joint custody or sole custody depending on the circumstances.
